Advice on what to do for an EBAY dispute

I need some help on what I should do. I paid and bought 2 yu-gi-oh cards on August 30. Then in two weeks when the 'package' came only one card was there. I emailed the seller with no response until I opened up an EBAY dispute case. Then the seller said that he/she forgot and will send over the missing card but yesterday when I received the card in the mail it was the wrong card. I all ready emailed the seller again about the wrong card (currently no reply back) and I am planning on sending back the wrong card in hopes that this time I can get the right card that I paid for. The thing is that my EBAY dispute case closes on Oct 5, 2011 so I am wondering if I don't get a response by Oct. 4 then should I use the Paypal dispute option before the deadline since what if the third time something goes wrong again?

I'm not very familiar with eBay disputes, but I have had to open Paypal disputes before. I know that the buyer can at any time choose to escalate a Paypal dispute into a Case. Once you do that, Paypal takes over and looks at both the buyer and seller, then makes a judgement in the Case. It is almost always decided in favor of the buyer (I had a Paypal representative tell me this one time when I called in for advice), so you would be likely to at least get a refund for the missing/incorrect card.

Thank you for the advice. I have decided to let it go because the card is like only $2. I have sent the wrong card over to the seller and I hope that he/she can sent me the right if not then well it is only $2.
