I couldn't find the original thread of the selling of Baybreeze on ebay, so I thought it a good idea to have a thread for ANY reports on selling Baybreeze.

Could it possibly be stickied to keep the post up?

I wasn't sure if it was technically "selling" because it was offered "free" with the purchase of Skywishes. Illegal, or loophole?
 
well to put it simply that MLP fair exclusive is going to be on the store shelves so it doesn't really excite me to the point where I HAVE to have one. Personally I think if someone wants to sell their bay breeze..its theirs who cares..i know some people do but me personally..its their property to sell, they paid for the tickets, went and got their pony. so really because the fair people said no your not allowd to sell it is kinda pointless..they didn't sign a contact or anything to hasbro stating "I will not ebay my exclusive" as far as I know, so really theres nothing noone can do but not bid on it. Its like Hasbeo saying you can't sell Frilly Frocks because shes mail order only..am I right?
 
Illegal? I must have missed this story :p Why is it illegal to sell her?
 
It is illegal to sell the MLPfair Exclusive Bybreeze, not the one that will be in stores. The exclusive apparently came with a special card and is marked differently than the one that will come out.

I asked for a sticky because it keeps the post up. It can always be removed later as the mods see fit (even when the store version of baybreeze comes out).

Hasbro agreed to release her early to the MLP Fair goers under the condition that people not sell her. She can be traded or given away, but not sold. People who got her from the fair- you didn't purchase her, you got her free with your purchase of a fair ticket, in thanks of helping to support the fair. It doesn't matter if you didn't sign anything. I'm sure they had a notice somewhere there.



Someone who knows more about Baybreeze from the fair help me out please?
 
I dont think its totally illegal, the only thing that may come of it is hasbro wont donate items anymore to the Fair. 5 yrs from now are the rules going to apply? I don't think so, you'll see it on ebay theres no doubt about it. I could see not selling it before the bay breeze is realeased to public, but this one an exclusive no matter what you do, so i dont think it would matter if someone sold her. I think what hasbro was trying to avooid is someone making mega $$ because she not available yet and this ones special exclusive.

She said in her item description:

"I personally signed no contract, so am under no obligation. However, I don't want to ruffle the feathers of the MLP Fair staff and/or Hasbro. Just to make it clear...you are purchasing Skywishes and getting Bay Breeze as a free bonus."


So if Hasbro said that Bay Breeze couldn't be sold, but can be given away or traded, then I guess this seller wouldn't be liable because technically she is saying Bay Breeze is a free bonus with Skywishes. Kinda clever of them I say to do the buy one get one free thing :eek:
 
There are no exceptions to the open live auctions links.

As far as my opinion on the selling of Bay Breeze. The people who signed the agreement (wether online or in person) are in fact bound to not sell her, they agreed after all. People who received her second hand (as a gift, or bought her from someone else) I would think are not bound by this agreement, since they didn't personally sign/agree to it.
But that's just my opinion. *shrugh*

As far as I understand the rules of the board. You may not post live auction links unless it's your own auction or a closed auction.

Edited to add: for the sake of argument, that other live auction link has been removed. Got to keep it fair for everyone.

Yikes, I had no idea that Bay Breeze being sold would escalate so much. Just so we could keep this topic about the selling of Bay Breeze instead of a debate on posting open auction links, I posted an open auction links topic on the debate board. That way we could keep this topic about the selling of Bay Breeze instead :wink:
