please check.. ebay auction. what should I do?

I won an auction for a MOC ponywear outfit. Auction states "some staples" "looks never removed" however, when the item came, I see that the staples go all the way around the card, and is the only thing holding it on. It's quite obvious that it has been removed from the card before, and I don't see the sticker in there anywhere.

I emailed the seller, and she says she feels she described the item accurately and was not misleading. I hate leaving negatives, but should I anyway?

After a response like that, I would leave negative. It will help future buyers.

Edit:
Just wanted to add the auction was very misleading. Advertising MOC then adds a few staples. Seems to me she is trying to be sneaky that way.
 
actually I got two replies from her. Maybe she's schizophrenic and personality #1 didn't tell #2 that my email had been answered? They sure *seem* like they were written by different people..

She's right, it wasn't a lot (after shipping it was more of a regular price), but does the price really factor into the matter? I mean, I'd be angrier if I spent more, but I'm dissatisfied with the auction regardless. Meh.


***edit: pink, I didn't think of it that way. I don't know if that was her intention or not, but I see your point.

When I look at the pic in the auction I don't see any staples what so ever. Are you sure the pic in the auction is of what you got? Otherwise that is missleading.

Since she is so unwilling to co-oporate and make both of you satesfied I would at least leave her a neutral.

Did she at least charge actual shipping costs or was the $4 more than what was spent shipping the item? If she charged more than what was paid, then I would get her on that too.

I think you deserve a partial refund as the item was described as "Mint on Card" and is not mint on card by any means. after it was taken off it was no longer MOC and can not be restored to MOC. Just my opinion. She mislead you in the auction.

So do I, I can't STAND mistakes and misspells like that, I even correct the chat-talk of my friends!! o_O *barfs from the horror of 1st grade LA*

Oh, and, uh, o_O = that person, that's just plain weird they sent two replies. Though, saying that it LOOKS MOC is reasonable, however, they should've stated it had been removed/was only held on by staples. Leave a neutral and say it wasn't EXACTLY as described, and could've been done better.

That shows the staple placing. If I were to give her credit for anything, it's for stapling it in such a way that not *much* is taken away from the overall image. However, they're very spread out and I could easily pull out that belt with tweezers without disturbing the staples, and like I said, I don't see the sticker. "Some Staples" just DOES NOT accurately describe "glue completely worn away, only being held by staples" because that's the condition it is in in reality.
 
after looking it over from what I see it was misleading in a sense because you couldn't actually SEE its flaws. that seller in being honest should have enlarged the stapled areas better..it may as well be ripped open and save the backcard as a collection..but its not my stuff,but I'd open it and save the card myself. I think the pleasure of opening it up carefully would make me feel a little better.
 
If you look closely in the picture you can see three of the staples.. one on the left, next to the shoes; one on the right, next to the belt; and just barely one on the left next to the outfit. The others I can't see in the pic either but I know where they are.


The seller emailed me, saying I need to send it back and get a refund. Did not specify if she would refund the shipping cost, PLUS I'd have to pay to send it to her.. and she'd probably slap me with some kind of "damaged in shipment" crap.


I looked through her feedback, she's a power seller but she has quite a lot of negatives for improper descriptions.

I think what the seller meant was "Looks like it was never removed", but thanks to her craptacular grammar, if I'd seen that auction I would have interpreted it as, "Look! Never removed!"

She was purposely being misleading, IMO. Definitely deserves a neg.

Or maybe that would be "Deserves a neg???? for trying to fool the customer????"

MOC - mint on card, not mint on SEALED card. Some toycollectors use MOSC for stuff that was never opened and MOC for mint stuff that has been opened and put back.

MOC means My Own Creation in Lego collecting circles. So unless you specifically ask if it has never been removed, describing it as MOC, could be technically correct.

There is also the term NRFB/C which means "Never Removed From Box/Card".
